1. Towards a Safer Khayelitsha – Report of the Commission of Inquiry August 2014

On 25 August 2014 the Commissioners, Justice Kate O’Regan and Advocate Vusumzi Pikoli, publicly presented their findings to the Premier of the Western Cape, Helen Zille, at Lookout Hill in Khayelitsha.

Minister challenges the Commission in the High Court

Judgment

1. Majority Judgment of the Western Cape High Court (14 January 2013)

On 14 January 2013 the Western Cape High Court dismissed an urgent application by the Minister of Police and the South African Police Service to stop the O’Regan-Pikoli Commission of Inquiry. In the majority judgment, Judge James Yekiso wrote that the Premier of the Western Cape had acted within her constitutional powers, and that she had oversight over the police. Judge Janet Traverso agreed.

2. Dissenting Judgment of the Western Cape High Court (14 January 2013)

In the dissenting judgment, Judge Vincent Saldanha, largely agreed with the majority judgment, but called for more cooperation between the parties. Judge Saldanha would have ordered the parties to negotiate an outcome and report back to the court by 31 January 2013.

Khayelitsha organisations lodge a complaint with the Premier

1. Original Complaint 28 November 2011

On 11 November 2011, 1500 people marched to the Western Cape Provincial Parliament to lodge an official complaint with the Premier of the Western Cape, Helen Zille.  The complaint was signed by representatives of five community based organisations working in Khayelitsha: the Social Justice Coalition, the Treatment Action Campaign, Equal Education, Ndifuna Ukwazi, Triangle Project and Free Gender.

The complaint called for the Premier to establish a Commission of Inquiry to investigate allegations of police inefficiency and a breakdown in relations between the police and the community of Khayelitsha. The complaint listed eight cases that these organisations described as “only a small sample of the widespread inefficiencies, apathy, incompetence, and systemic failures of policing routinely experienced by Khayelitsha residents”.

2. Supplement to the Original Complaint 4 April 2012

On 6 March 2012 the complainant organisations met with the Premier of the Western Cape. The complainants argued that if the Premier appoints a Commission of Inquiry, it must have a mandate to investigate both the South African Police Service and Cape Town’s Metro Police. The Premier gave the complainants an opportunity to provide a supplement to the original complaint. The supplement would help her decide whether or not to appoint a commission, and which state agencies to involve.

The supplement to the original complaint was submitted to the Premier on 4 April 2012.

3. Open Letter to the Premier of the Western Cape 14 June 2012

On 14 June 2012 the branch leaders from the Social Justice Coalition wrote an open letter to the Premier of the Western Cape urging her to establish a Commission of Inquiry.

4. Western Cape Provincial Gazette 7026 24 August 2012

On 24 August 2012 the Premier of the Western Cape established a Commission of Inquiry into alleged inefficiency by police and a breakdown of relations between the community and police in Khayelitsha.
